LEGAL STATUS OF INTERNALLY DISPLACED PERSONS IN UKRAINE

Abstract

It was established that the ongoing military aggression by Russia against the territorial integrity of Ukraine led to serious processes of internal and external population migration. It is emphasized that the issue of researching the mechanisms of public management and administration of the social integration of this category of people is very relevant. The purpose of the article is to define the characteristics and social guarantees of the legal status of internally displaced persons in Ukraine. It was determined that, as a general rule, the realization of the status of an internally displaced person requires an individual approach to the use of provided social guarantees, however, a number of guarantees are provided for family members of such a person. It was found that the legal status of internally displaced persons is established by a separate special legislative act. Thus, in accordance with the Law of Ukraine "On Ensuring the Rights and Freedoms of Internally Displaced Persons", the registration of this category of citizens in the form of the operation of a single information database on internally displaced persons is established. It was determined that the procedure for creating, maintaining and accessing information of the Unified Information Database on Internally Displaced Persons is determined by the Cabinet of Ministers of Ukraine. The National Social Service Service of Ukraine is responsible for implementing and maintaining a single information database on internally displaced persons, which is the central body of the executive power for forming and ensuring the implementation of state policy in the areas of social protection, social services for the population, volunteer activities, and family matters and children, rehabilitation and recreation of children, as well as protection of the rights of persons deported on the basis of nationality who returned to Ukraine. It was concluded that the grounds for acquiring the legal status of an internally displaced person are determined in accordance with Art. 4 of the Law of Ukraine "On Ensuring the Rights and Freedoms of Internally Displaced Persons", which stipulates that a person's residence in the territory where such circumstances as armed conflict, temporary occupation, widespread manifestations of violence, human rights violations, natural or man-made emergency situations have arisen , is the reason for the transfer of persons belonging to the group of social risks for a person and requiring additional care from the state.
