FEATURES OF STATE REGULATORY MECHANISMS IN THE FIELD OF SUPERVISION AND CONTROL OF COMPLIANCE WITH LABOR LEGISLATION

Abstract

In the article, the justification of theoretical provisions and the development of practical recommendations for improving the mechanisms of state regulation in the field of supervision and control over compliance with labor legislation. In the sphere of state management and administration, the peculiarities of mechanisms of state regulation in the field of supervision and control over compliance with labor legislation are investigated. The methodology of state regulation mechanisms in the field of supervision and control over compliance with labor legislation is characterized by appropriate measures carried out by state bodies and authorized persons. Measures of state control over compliance with labor legislation are carried out in the form of inspection visits conducted by labor inspectors of the State Labor Service and its territorial bodies. The scientific novelty of the obtained results is that the peculiarities of the mechanism of state regulation in the field of supervision and control over compliance with labor legislation are manifested through the grounds for conducting inspection visits. The peculiarity of the mechanism is that the inspection visit or the decision of the labor inspector to visit the employer is subject to notification registration by the State Labor Service or its territorial body before the start of their implementation. It is emphasized that, if necessary, representatives of trade unions, their organizations and associations whose members work at the object of visit, employers' organizations and their associations, state bodies. It is noted that during an inspection visit, the object of the visit has the right to check with the labor inspector for the presence of an official certificate and to receive a copy of the referral for the inspection visit. It was concluded that drawing up an act of inspection based on the results of an inspection visit and, in the event of violations of the requirements of the labor legislation, an order to eliminate them and a warning about responsibility for violations of the labor legislation are important factors of the state regulation mechanism.
