FORMATION OF STATE POLICY IN THE FIELD OF BIOETHICAL REGULATION OF EXPERIMENTAL ACTIVITIES

Bioethics is the basis of ethical regulation of medical and scientific experiments, as it concerns the dignity, right to life and health of a person. In the context of the development of biomedical technologies, the importance of bioethical standards is constantly growing. Ukraine lacks a holistic analysis of state policy in the field of experimentation, built on the principles of bioethics, and current legislation remains fragmentary. The purpose of the article is to analyze the conduct of experiments on humans through the prism of bioethics in the context of state policy and to identify areas for improving legislative regulation.This article offers an overview of current approaches and identifies areas for improving bioethical regulation, taking into account international experience.Bioethics formulates the principles of balance between the development of science and the preservation of human life and health. The state must implement these principles by improving legislation. A person as a person is inviolable and may participate in experiments only with his own informed, voluntary consent. Experiments should not disrupt the functioning of the organism or hinder the development of the personality. The state, society and medicine have only those rights regarding the patient that he himself grants them. Experiments should be based on laboratory research and animal testing to minimize the risks of conducting them with the involvement of humans. The inviolability of human dignity excludes experiments on persons who are unable to give consent. These include embryos, minors, arrested persons, people with mental disorders and terminally ill persons. Only therapeutic experiments aimed at their benefit are permissible.It is necessary to amend Article 45 of the Law of Ukraine “Fundamentals of Ukrainian Legislation on Health Care”, supplementing the list of prohibited categories with embryos, recognizing their right to legal protection from the moment of fertilization.
